Text	[Eagle vs. Pastime 9/2/1859] Furey was on the 3d base, when Barre was put out at left field by a catch on the fly–the former was running home, but returned and touched his base, and then made his run. The Eagles appealed, stating that Furey could not run until the ball had been in the hands of the pitcher; in this they were mistaken. Rule 16 says, “No ace or base can be made upon a foul ball, nor when a fair ball has been caught without having touched the ground. In the former instance” (viz, in the case of a foul ball) “the ball shall be considered dead, and not in play until it shall have been settled in the hands of the pitcher. In either case the players running the bases shall return to them.” Now, if it was requisite that in both instances the ball should be settled in the hands of the pitcher there would have been no need of alluding specially to the case of a foul ball, and therefore the inference to be drawn is unmistakable.
